JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 13-12-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Sahebpur Kamal P.S. Case No. 235/2018 registered for the offences punishable under Sections 30(a), 32(3), 35(c) and 36 of the Bihar Prohibition and Excise Act, 2016.

According to the prosecution case, the informant got confidential information that petitioner and other F.I.R. named accused were indulged in selling illicit liquor but, admittedly, when informant and other police officials conducted raid, the illicit liquor was recovered from the houses of two F.I.R. named accused persons and nothing was recovered from the house of the petitioner. Patna High Court Cr.Misc. No.64635 of 2018(2) dt.13-12-2018 2/2 been granted privilege of anticipatory bail by a Co-ordinate Bench of this Court vide order dated 01.10.2018 passed in Cr. Misc. No. 59806/2018.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II - cum - Special Judge, Excise Act, Begusarai in Sahebpur Kamal P.S. Case No. 235/2018 subject to conditions as laid down under Section 438(2) of the Cr.P.C. (Hemant Kumar Srivastava, J) Spd/- U T
