JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 23-11-2022 Heard learned counsel for the petitioner, learned counsel for the complainant and learned APP for the State. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 406, 420 and 323/34 of the Indian Penal Code and later on added Sections 417 and 406/34 of the IPC.

Allegedly, it is a case of breaching the trust of the complainant and not executing the sale deed in favour of the complainant by the petitioner in spite of receiving Rs.14 lakh in total.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He

Patna High Court CR. MISC. No. 66278 of 2021(8) dt.23-11-2022 2/2 further submits that petitioner is neither executed any agreement for sale of land nor received any amount from the complainant. Petitioner has clean antecedent.

Learned APP appearing for the State as well as the complainant has opposed the prayer for anticipatory bail and submitted that the petitioner was in agreement with the complainant to sell the land.

Considering the aforesaid submissions, let the petitioner, above named in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Judge-VIII-cumACJM, Patna in connection with Complaint Case No. 2806(C) of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
