The petitioner is apprehending his arrest in connection with Kotwali P.S. Case No. 555 of 2014 corresponding to G.R.No.3056 of 2014 for the offences instituted under Sections 341, 342, 323, and 308 /34 of the IPC.
The prosecution story, in brief, is that on 15.08.2014 the petitioner along with other co-accused persons called the informant on phone in shop and took him inside the shop and after bolting the door assaulted the informant with fists, legs and iron rod. They also assaulted him by iron rod causing injury on his head. The accused persons also assaulted the informant causing injury on his mouth, eye, temple and heart by stick on account of
Patna High Court Cr.Misc. No.27501 of 2016 (2) dt.13-07-2016 2/3 which he fell down. The accused persons were making allegation that the informant had stolen the ornaments amounting to Rs. 5/- lacs and were telling him to return the same otherwise they threatened him of dire consequences. They confined him in the room for about four hours. They had also threatened him to throw him in Barari Bridge in night. The informant informed his brother on his mobile upon which his brother along with the police came there and they took him to the police station from where he was sent to hospital.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is a case and counter case between the parties. From perusal of the impugned order it appears that no specific allegation has been attributed against the petitioner rather general and omnibus allegation has been made.
On behalf of the State it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Kotwali P.S. Case No. 555 of 2014 corresponding to G.R.
Patna High Court Cr.Misc. No.27501 of 2016 (2) dt.13-07-2016 3/3 No.3056 of 2014 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Bhagalpur, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
