02. 29.08.2016 Heard parties.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 337, 504 and 307 of the Indian Penal Code.

It is contended on behalf of the petitioner that as per allegation 40-50 persons assembled at the police station and started brick-batting as they wanted to kill one Anil Chaudhary, a murder accused. Out of them, Chowkidar has identified about twelve persons including the petitioner. It is urged that there is general and omnibus allegation against 40-50 persons including 12 named in the FIR. Nothing specific has been attributed to the

Patna High Court Cr.Misc. No.29612 of 2016 (2) dt.29-08-2016 petitioner. It is further contended that the petitioner is having clean antecedent.

Having regard to the facts and circumstances of the case, let the petitioner, namely, Ram Chandra Bhuiyan be released on bail in the event of his arrest/surrender before the court below within a period of six weeks from today in connection with Maigra P.S. Case No. 17/2015, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Sri G.N. Dubey, Judicial Magistrate, 1st Class, Sherghati, Gaya or his successor subject to the conditions as laid down under subsection (2) of Section 438 of the Code of Criminal Procedure. However, at the time of accepting bail bond, the court below will verify and assure itself regarding the criminal antecedent of the petitioner. If the petitioner is having clean antecedent then his bail bond would be accepted otherwise he would be taken in custody.
