JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04/ 17.11.2016 Heard learned counsel for the petitioners as well as learned Addl. Public Prosecutor for the State. Petitioners apprehend their arrest in connection with a case registered under sections 363, 420, 467 and 471/34 of the Indian Penal Code.
It is alleged that petitioners took the informant's father and got executed a registered sale deed in favour of petitioner no.1. It is also alleged that father of the informant was mentally derailed person.
Submission on behalf of the petitioners is that father of the informant executed registered sale deed in favour of petitioner no.1 after taking consideration amount but later on, after one month of the execution of the aforesaid sale deed, informant lodged the present case and so far as petitioner no.2 is concerned, he is said to be identifier on the aforesaid sale

Considering the aforesaid facts and circumstances as well as submissions of the parties, in the event of arrest/ surrender within six weeks from the date of receipt of this order to the concerned court, let the petitioners be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of Smt. Divya Shekher, Judicial Magistrate, Saran, Chapra/ concerned court in Sahajitpur P.S. Case no. 21/2016 subject to condition as laid down under section 438(2) of the Cr.P.C.
