ANJANA MISHRA ORAL ORDER 29-09-2016 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Udwant Nagar P.S. Case No.384 of 2014 for allegedly having committed the offence under Sections 147, 148, 149, 323, 325, 337,338, 353, 332, 333, 504, 506, 151, 152 and 160 of the Indian Penal Code.

Learned counsel for the petitioner submits that there was a commotion at the counting of votes of the PACS election and a crowd had gathered at the Centre where the counting is taking place. Since there was a disturbance, the petitioner has been named along with others as being part of the crowd. The means of identification has not been stated and the petitioner

Considering the nature of allegations made and that the petitioner has no criminal antecedent and also that at best he may be treated as a member of the crowd, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of `10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur at Ara, in connection with Udwant Nagar P.S. Case No.384 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
