The petitioner apprehends his arrest in Barari (Semapura O.P.) P.S.Case No.109 of 2016 under Sections 376 and 511 of the Indian Penal Code.

The complainant filed complaint case no.1938 of 2008 on 05.07.2008, the same was sent to the institution and investigation of the case on the basis of which Barari P.S.Case No.114 of 2008 was registered on 13.08.2008. The police after investigation submitted final form finding the case false but on the same complaint petition, it appears that the present case Barari (Semapura O.P.) P.S.Case No.109 of 2016 was registered. Considering the aforesaid facts, the above named petitioner, in the event of his arrest or surrender before the learned

No.29742 of 2016 (2) dt.05-09-2016 court below within a period of four weeks from the date of receipt/production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Katihar in Barari (Semapura O.P.) P.S.Case No.109 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
