The petitioner seeks regular bail in connection with Charpokhari P. S. Case No. 84 of 2017 registered for offences punishable under Section 394 of the Indian Penal Code The prosecution case as lodged on the basis of written report by the informant that when he was returning from Gaya from his place of business, he was intercepted by three unidentified miscreants and snatched his motorcycle and fled away.
It has been submitted that the name of the petitioner has been surfaced in the crime on the confessional statement of Baja @ Kush Kumar and stated that the stolen motorcycle has been recovered from the place of other accused, as has been contended
Patna High Court Cr.Misc. No.59247 of 2017 (3) dt.15-01-2018 2/2 on behalf of the petitioner that nothing has been recovered from his possession and except confessional statement, there is no incriminating materials against the petitioner. It has been further submitted that petitioner has got no criminal antecedent and he is in custody since 16.08.2017. Considering the facts and circumstances and the materials on record, let the petitioner, above named be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-4th, Bhojpur at Ara in connection with Charpokhari P.S.Case No. 84 of 2017.
