Petitioners are apprehending their arrest in connection with Akbarpur PS Case No. 73/2015 for the alleged offence under Section 304B/34 of the Indian Penal Code. Learned counsel representing the petitioners with reference to Annexure-2, statement of the victim girl under Section 164, CrPC, submits that the foundation of the instant case is false as the girl Priti Kumari who is alleged to have been killed in the instant case by the petitioners' side is alive and she has given her statement under Section 164, CrPC. Considering the aforesaid as also the fact that the petitioners have no criminal antecedent, this application is allowed.

Chief Judicial Magistrate I, Nawada in connection with Akbarpur PS Case No. 73/2015 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
