JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 10-04-2015 Heard learned counsel for the petitioner and the other side. The petitioner apprehends arrest in a case under sections 307 and other allied sections of the Indian Penal Code as well as under the SC and ST Act.

Learned counsel for the petitioner submits that no case under the SC and ST Act would be made out as the alleged occurrence took place inside the house. Furthermore, no case under section 307 IPC is made out against the petitioner and there is case and counter case and injuries have been sustained on both sides.

In the facts and circumstances of the case, in the event of arrest/surrender, let the petitioner as mentioned above be released on bail on furnishing bail bond of Rs.5,000/- with two sureties of the like amount each to the satisfaction of JM, 1st class, Samastipur in Patori Police station Case No. 371 of 2013.
