JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-11-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The report of the trial court goes to show that trial of the petitioner has already commenced and two prosecution witnesses have already been examined. Therefore, in the aforesaid circumstance, again, I am not inclined to release the petitioner on bail and hence, his prayer for bail in connection with Session trial no. 326 of 2015 arising out of Madhwapur P.S.Case No. 28 of 2015, pending in the court of Additional Session Judge-VI, Madhubani stands rejected.

However, the trial court is directed to expedite the trial of the petitioner and try to conclude the same as early as possible, preferably, within six months from the date of receipt/

No.52037 of 2017 (3) dt.15-11-2017 2/2 production of a copy of this order and if the trial of the petitioner is not concluded within the above stated period due to laches of the prosecution witness, the petitioner may renew his prayer for bail before the trial court itself.
