2. The petitioner apprehends arrest in connection with Baliya P.S. Case No. 165 of 2021 for the offence registered under Section 30(a) of Bihar Prohibition & Excise Act.

3. As per the prosecution case, on a secret information, the police reached at a bamboo orchard near Fulwariya Railway Station and on search two empty gallons and manufacturing articles of illicit liquor were recovered from the spot.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case on the basis of suspicion. Petitioner was neither present on

Patna High Court CR. MISC. No.56889 of 2025(2) dt.08-09-2025 2/2 the spot nor any incriminating article has been recovered from the conscious possession of the petitioner. Petitioner has no concern with the seized articles from the place of occurrence. Petitioner is a senior citizen aged about 65 years having no criminal antecedent. He undertakes to cooperate in the investigation and trial.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Judge, Excise -II, Begusarai, in connection with Baliya P.S. Case No. 165 of 2021, subject to the conditions as laid down under Section 482(2) of the B.N.S.S., 2023.
