2. The petitioner apprehends his arrest in connection with Singhaul P.S. Case No. 66 of 2025, instituted under Section 30(a) of the Bihar Prohibition & Excise Act.
3. There is recovery of 20 litre illicit liquor from the E-rickshaw and one person, namely, Ghanshyam Kumar was apprehended.
4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case on the disclosure statement co-accused Ghanshyam Kumar with ulterior motive. Except the disclosure statement, there is no material against the petitioner. Petitioner was not present on the spot and nothing has been recovered from his possession.
Patna High Court CR. MISC. No.54618 of 2025(2) dt.19-08-2025 2/2 Petitioner has no concern with the recovered liquor. Petitioner has no criminal antecedent. Petitioner undertakes to co-operate in the investigation and trial.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.
6. Considering the facts and circumstances of the case and submission of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Judge-I, Begusarai in connection with Singhaul P.S. Case No. 66 of 2025, subject to the conditions laid down in Section 482 (2) of the Bharatiya Nagrik Suraksha Sanhita (B.N.S.S.), 2023.
