JUSTICE ARUN KUMAR ORAL ORDER 19-02-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Belthar PS Case No. 52 of 2017 registered under Section 396 of the IPC. The allegation in brief is that six motorcycle borne miscreants looted money from the informant's brother and also in the process shot him dead.

Learned Counsel for the petitioner submits that the FIR is against unknown, there is no recovery from possession of the petitioner, merely on suspicion without any basis he was apprehended and put on TIP but not identified by the Munsi of the deceased who was going together with the deceased and by another witness, though other persons have been identified however he had no criminal antecedent prior to this case, only after institution of the present case later on made accused in two other cases and is in custody since 20.6.2017.

Having considered the said facts and circumstances, the petitioner, namely, Asraf Sai @ Ambuj is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of 7th ACJM, West Champaran at Bettiah in connection with Belthar PS Case No. 52 of 2017.
