NILU AGRAWAL ORAL ORDER 29-04-2015 Heard learned counsel for the petitioner. The petitioner apprehends his arrest in Nirmali P. S. Case No. 21/2014 instituted for offences punishable under Sections 341, 323, 324, 307, 498A of the I.P.C.

The informant Paro Devi, mother-in-law of the petitioner, has stated in the fardbeyan that on 19.03.2014 at 9.30. A.M., her daughter Raj Kumari Devi, wife of Amar Sah (petitioner) and her younger daughter Chanda Kumari were at her house. In the meantime, her son-in-law, Amar Sah (petitioner) came to her house with a knife in his hand and threatened Raj Kumari Devi (wife) to kill her and made injury on both arms, left hand and chest.

A supplementary affidavit has been filed by the fatherin-law of the petitioner Jagannath Sah, which is kept on record,

Patna High Court Cr.Misc. No.41976 of 2014 (3) dt.29-04-2015 2/2 and wherein he has stated that due to misunderstanding, the case has been lodged by Paro Devi, the informant and the petitioner has never tortured his daughter.

In view of the said supplementary affidavit, it is directed that in the event of arrest or surrender within a period of four weeks from today, the above named petitioner Amar Sah @ Amrendra Kumar Sah @ Amar Kumar Prasad shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Birpur (Supaul) in connection with Nirmali P. S. Case No. 21/2014, subject to condition as laid down under Section 438( 2) of Cr. P.C.
