The petitioners seek bail in anticipation of their arrest in connection with Dhoraiya P. S. Case No. 204 of 2017 dated 06.10.2017 instituted for the offences under Sections 341, 323, 324, 325, 379, 504, 506 and 34 of the Indian Penal Code.
From perusal of the F.I.R., it clearly appears that the occurrence arose out of fight between children and the elders also entered in the fray. The injuries suffered by the
Patna High Court Cr.Misc. No.63980 of 2018(2) dt.13-12-2018 2/2 victims are simple in nature. The petitioners do not have any criminal antecedents.
Regard being had to the nature of the occurrence and that the petitioners do not have any criminal antecedents, they are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt / production of a copy of this order, on their furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in connection with Dhoraiya P. S. Case No. 204 of 2017 subject to the conditions as laid down under Section 438 (2) Cr.P.C. (Ashutosh Kumar, J) skm/- U
