2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 376, 379, 493, 341, 323, 504/34 of the Indian Penal Code.
3. Prosecution case, in brief, is that on the false pretext of marriage, this petitioner procured sexual intercourse with the informant for the last four years. Later on, refused to marry and assaulted the informant and snatched cash and jewellery.
4. Learned counsel for the petitioner submits that it is apparent from the F.I.R. that relationship developed between the parties in 2019 and both were major. They were in relationship with each other for quite some time and enjoyed each other's company. As such, the relationship cannot be said to be induced, involuntary or result of misconception. Considering the facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Gaya in connection with Mahila P. S. Case No. 26 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
