JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 01-10-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The present case was registered on the basis of fardbeyan of the victim's wife. The victim's wife claimed herself to be the eye witness of the present occurrence but she did not name the petitioner. The name of the petitioner came in this case when the statement of the victim was recorded. The victim stated that altogether six named and some unknown persons assaulted him but no specific overt act has been attributed against the petitioner. Moreover, co-accused, Mishri Yadav, Dharamraj Yadav and Girani Yadav have already been granted the privilege of bail by this Court.
Accordingly, the above named petitioner is
Patna High Court Cr.Misc. No.46099 of 2015 (2) dt.01-10-2015 2/2 directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Pakribarawan (Dhamaul) P.S. Case No. 49 of 2014 to the satisfaction of the Sub-Divisional Judicial Magistrate, Nawada.
