This application for grant of anticipatory bail arises out of Manihari P.S. Case No. 39 of 2016, disclosing offences under Sections 380, 504, 420, 406/34 of the Indian Penal Code. The petitioner is said to be the cousin of the informant, who is said to have committed theft of the informant's A.T.M. card on 18.11.2014 and withdrew a total sum of Rs. 14,900/- on different dates with the help of the said ATM card. It is also alleged that the petitioner had initially agreed to refund the said amount to the informant but subsequently declined. Considering the nature of allegation and the submissions advanced, this application is allowed. Let petitioner above-named

in the event of his arrest/surrender within four weeks from today in the Court below be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Katihar in Manihari P. S. Case No. 39 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
