The petitioner, who is brother of husband of the deceased and in custody in connection with Darauli P.S. Case No.80 of 2012 registered for the offence under section 498(A) / 304 (B) / 201 of the Indian Penal Code, has prayed for grant of bail.
It was submitted by learned counsel for the petitioner that initially a complaint case was filed and subsequently the complaint was referred to police and F.I.R. was lodged vide Darauli P.S. Case No.80 of 2012. It has been emphatically argued that almost in similar circumstance one of the co- accused namely Basisth Chaudhary @ Basistha Yadav who is also
Patna High Court Cr.Misc. No.44804 of 2014 (2) dt.04-02-2015 2/2 brother of the husband of the deceased has been granted bail on 11.2.2014 vide Cr. Misc. No. 54304 of 2013. It has been argued that case of petitioner is almost similar to the case of Basisth Chaudhary @ Basistha Yadav.
Keeping in view the fact that the case of petitioner is almost on similar footing as that of Basisth Chaudhary @ Basistha Yadav, who has already been extended the privilege of bail vide Cr. Misc. No.54304 of 2013, there is no reason to deny the relief to the petitioner.
Accordingly, let the petitioner Ram Nath Yadav be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned ADJ IV, Siwan in connection with Darauli P.S. Case No. 80 of 2012.
