ANJANA MISHRA ORAL ORDER 28-10-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 7 of the Essential Commodities Act.

Learned counsel for the petitioner submits that earlier he had been granted police bail, but for certain circumstances, beyond his control, he could not present himself at the time he was issued summons.

In view of the fact that the petitioner could not respond to the summons, his bail bonds had been cancelled and a fresh warrant has been issued against him.

Considering the nature of allegation as made against the petitioner and that nothing was recovered from possession of the

No.32426 of 2016 (2) dt.28-10-2016 P2/2 present petitioner, let the petitioner abovenamed, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Dalsingsarai in connection with Ujiyarpur P.S. Case No. 164 of 2009, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
