The petitioner seeks pre-arrest bail in connection with Mahila (Bhabua) P.S. Case No.47 of 2018 registered for the offence punishable under Sections 498A and 379 read with 34 of the Indian Penal Code.
It is contended by the learned counsel for the petitioner that admittedly the marriage had taken place in the years 2012 and the first information report has been instituted in 2018. He contended that there is no truth behind the allegation that the informant was subjected to cruelty for non-fulfilment of demand of dowry. The case has been instituted only because of matrimonial discord and incompatibility.
Learned counsel for the State opposed the application
Patna High Court Cr.Misc. No.65034 of 2018(2) dt.13-12-2018 2/2 for grant of pre-arrest bail to the petitioner. Considering the nature of allegation, in the event of arrest or surrender in the court below within a period of six weeks, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Kaimur at Bhabua in connection with Mahila (Bhabua) P.S. Case No.47 of 2018 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
