JUSTICE ASHUTOSH KUMAR ORAL ORDER 14-12-2018 The petitioner seeks bail in anticipation of his arrest in connection with Madhepura (Bharrahi O.P.) P.S. Case No. 312 of 2018, dated 15.05.2018, instituted for the offences under Sections 341, 323, 379, 307, 504 and 506/34 of the I.P.C.

The petitioner and others are said to have come to the field of the informant and assaulted him by means of an iron rod (khanti).

The learned counsel for the petitioner has

No.66467 of 2018(2) dt.14-12-2018 2/3 submitted that a false case has been instituted which would be reflected from the fact that the wife of the petitioner has filed a case against the informant and others for having assaulted the petitioner vide Mahila P.S. Case No. 28 of 2018. It has further been submitted that the injuries found on the person of the informant are all simple in nature.

It appears that there has been some kind of fight between the petitioner and the informant in which the informant has suffered minor injuries.

The petitioner does not have any criminal antecedents.

For the aforesaid facts, the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from the date of receipt/production of a copy of the present order, is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura in connection
