2. The petitioner seeks regular bail in Jainagar P.S. Case No. 146 of 2024 registered for the offence punishable under Sections-272, 273, 414/34 of the Indian Penal Code and 30(a) of Bihar Prohibition and Excise Act.

3. Allegedly, on the tip off, the informant along with other police personnel raided the place of occurrence from where, seeing the police party, three persons leaving three motorcycles succeeded in fleeing away whereas the petitioner was apprehended. On search of plastic bag kept on motorcycles, 1305 litres of wine is said to have been recovered.

4. Learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.59753 of 2024(2) dt.28-08-2024 2/2 that the petitioner is innocent and he has falsely been implicated in this case. He is the person of clean antecedent. It has further been submitted that nothing incriminating has been recovered from conscious possession of the petitioner. The petitioner is under incarceration since 11-05-2024.

5. Learned APP has opposed the prayer for bail and submitted that in huge quantity, illicit liquor was recovered.

Considering the aforesaid facts and circumstances, specially, the recovery of liquor in huge quantity, the petitioner named above, is directed to furnish bail bond after two months from today and on doing so, he shall be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, Excise Act, Madhubani in connection with Jainagar P.S. Case No. 146 of 2024.
