JUSTICE ASHUTOSH KUMAR ORAL ORDER 05-12-2017 The petitioner seeks bail in connection with Angar Ghat P.S. Case No. 26 of 2017 dated 18.03.2017 instituted for the offence under Section 302 of the Indian Penal Code. The petitioner is the husband of the deceased. With respect to her death in the year 2008, an UD case was registered on 05.03.2008. Later, on the basis of the report of the Doctor who had conducted the post-mortem that the death was because of asphyxia and throttling, the present case was registered. The petitioner is in custody since18.06.2017. Considering the fact that death had occurred in the year 2008, whereas the present case has been registered only in the year 2017, this Court is inclined to grant bail to the petitioner.
