ANJANA MISHRA ORAL ORDER 08-10-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with Sonbersa Raj (Kashnagar O.P.) P.S. Case No. 112/2018 registered for the offences punishable under Sections 188/353/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the allegation against the petitioner is that he was part of the mob which was engaged in raising protest against the illegal collection of rent from the residents of the area and the petitioner had come there to protest against the same. The present case has been filed by the Circle Inspector on the written report of the Circle Officer who had been engaged in collection Government Revenue which was above the fixed rent. Learned counsel submits that he had

Patna High Court Cr.Misc. No.61721 of 2018 (2) dt.08-10-2018 2/2 gone for purchasing medicines and has been falsely implicated in the present case and no specific role has been attributed to the present petitioner.

Considering the aforementioned facts and circumstances and the petitioner has no criminal antecedent, let the petitioner in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned Chief Judicial Magistrate, Saharsa, in connection with Sonbersa Raj (Kashnagar O.P.) P.S. Case No. 112/2018, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
