ANJANA MISHRA ORAL ORDER 19-12-2018 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are apprehending their arrest in connection with Sultanganj P.S. Case No.190 of 2016 for allegedly having committed the offences under Sections 147, 149, 323, 341, 353, 379 and 427 of the Indian Penal Code. Learned counsel for the petitioners submits that the main allegation against these petitioners is that they had entered into the office of the Circle Officer and disrupted him
Patna High Court Cr.Misc. No.65998 of 2018(2) dt.19-12-2018 2/2 in discharge of his duties and also torn the cheque, which has been prepared for the beneficiaries of the flood reliefs. It is further submitted that the petitioners are not having any criminal antecedents and similarly situated co-accused Dilip Yadav has since been extended the privilege of anticipatory bail in Cr. Misc. No.61456 of 2018, vide order dated 20.11.2018.
Considering the aforementioned facts and circumstances, let all the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-1st, Bhagalpur, in connection with Sultanganj P.S. Case No.190 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
