JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 07-09-2016 Heard the counsel for the petitioner and the State. The petitioner is facing accusation in Kishanganj P.S. Case No. 38 of 2016 registered under Sections 341, 323, 324, 307, 379/34 of the Indian Penal Code.

Five accused(s) named in the F.I.R. including the petitioner are said to have taken the petitioner to a distant place and on some plea an attempt was made to extort him. When the petitioner made an attempt to escape, it is alleged, a chase was offered and thereafter all the accused(s) persons named in the F.I.R. assaulted him with bricks on his head. After few days, the F.I.R. was lodged.

After making submissions at some length, Mr. Raj Kumar, the counsel for the petitioner, seeks permission of the

Patna High Court Cr.Misc. No.29449 of 2016 (2) dt.07-09-2016 2/2 Court to withdraw the application, enabling the petitioner to surrender and seek regular bail.

The application is permitted to be withdrawn with the aforesaid liberty.
