The petitioners apprehend their arrest in Fullidumar (Amarpur) P.S. Case No. 164 of 2015, registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code.

The informant named 16 persons along with the petitioners and alleged that they all came having armed with different weapons and assaulted the informant and his family members. There was a

Patna High Court Cr.Misc. No.30158 of 2016 (2) dt.09-09-2016 2/2 Panchayati but the petitioners did not obey the decision of the Panchayat.

Learned counsel for the petitioners submits that there is a counter version being Fullidumar (Amarpur) P.S. Case No. 163/2015. The police after investigation submitted charge sheet under Section 308 and other Sections of the Indian Penal Code. On account of land dispute, there was scuffle between both sides. From perusal of the record it appears that the informant and his family members got simple injury except one injury on the head of the informant caused by lathi which is grievous in nature, but there is no specific allegation against any of the petitioners as to who caused fracture injury among the petitioners.

Considering the facts aforesaid and the fact that the petitioners are 16 in numbers, the petitioners above named in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in connection with Fullidumar (Amarpur) P.S. Case No. 164/2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.)
