The petitioner seeks bail in anticipation of his arrest in connection with wajirganj P.S. Case No. 357/2017 dated 05.08.2017 instituted for the offences under Sections 467, 468, 420, 120(B) of the Indian Penal Code and Section 7 of the E.C. Act. Approximately 170 kgs of rice is said to have been recovered from a rickshaw on a busy road. It has been alleged in the F.I.R. that the petitioner is a PDS dealer who was trying to take away those 170kgs of rice, which was meant for the distribution amongst the beneficiaries, to some other places for black-marketing. Learned counsel for the petitioner has submitted that the recovery is at a distance of about 1 and 1⁄2 kms from the PDS shop and it is not sure whether the rice was of the PDS Centre or not.

Considering the aforesaid facts, the petitioner is directed to be released on bail, in the event of his arrest/surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bond in the sum of Rs. 10,000/- (Ten Thousand), with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. 1st, Gaya in connection with Wajirganj P.S.
