The petitioner seeks bail in connection with Excise Case no. 171 of 2017 registered under Section 30(a) (d) of the Bihar Excise and Prohibition Act 2016.
6 lts. of country made liquor and 975 Kg. Mahua are said to have been recovered from the Panchayat Ghar and petitioner was apprehended.
It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his conscious physical possession rather from the Panchayat Ghar. He has been falsely implicated in the case merely on suspicion as he was present there at the time of recovery. He has no concern
Patna High Court Cr.Misc. No.8566 of 2018(2) dt.17-02-2018 2/2 with the seized liquor. He has no criminal antecedent. He has been languishing in custody since 13.11.2017. In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise, Gaya in connection with Excise Case no. 171 of 2017.
