JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 13-12-2018 Heard learned counsel for the petitioners as well as learned Addl. Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Sitamarhi (Mahila) P. S. case no. 01/2018 registered under section 376 and other allied sections of the IPC and sections 4/6 of the POCSO Act.
Petitioners are relatives of the victim (informant) and allegation against them is that they along with other relatives and parents of the victim got her marriage forcibly solemnized with co-accused Suraj Paswan. However, parents of the victim as well as other relatives of victims have been already been granted privilege of bail by a different bench of this court.
Patna High Court Cr.Misc. No.64587 of 2018(2) dt.13-12-2018 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioners be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge I-cum- Special Judge, Sitamarhi in Sitamarhi (Mahila) P. S. case no. 01/2018 subject to condition as laid down under section 438(2) of the Cr.P.C.
