1. Heard learned Counsel for the parties concerned.

2. Learned Counsel for the petitioner submits that against the order passed by the District Appellate Authority, Gopalganj, in Appeal Nos. 106, 108 and 110 of 2012, petitioner had moved before State Appellate Authority, in Appeal No. 381/2019 and the State Appellate Authority

Patna High Court CWJC No.19725 of 2021(3) dt.22-12-2023 2/2 has remanded the matter back before the District Appellate Authority, Gopalganj, for reconsideration.

3. Learned Counsel for the petitioner submits that since at the time of filing the present writ application, the District Appellate Authority, Gopalganj, was not functioning, but, now, the District Appellate Authority, Gopalganj, has been constituted. Accordingly, he seeks permission to withdraw this application, with liberty to pursue the matter before the District Appellate Authority, Gopalganj.

4. Permission is granted.

5. This application is dismissed as withdrawn, with the liberty aforesaid.
