JUSTICE BIRENDRA KUMAR ORAL ORDER 05-01-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody in connection with Khagaria P.S. Case No. 127 of 2015, a case under Sections 302/120B of the Indian Penal Code.

Allegation against the petitioner is of commission of murder of the mother of the informant.

Co-accused Chandan Sahni has been allowed bail by a coordinate Bench of this Court in Cr. Misc. No.39300 of 2017.

Considering the fact that the post mortem report did not reveal that any sign of strangulation and the sister of the informant stated before the police that he was the man who had

No.57447 of 2017 (3) dt.05-01-2018 P2/ killed the mother, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Khagaria P.S. Case No. 127 of 2015, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
