JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-11-2018 The petitioner seeks regular bail in connection with Banka (Mahila) P.S. Case No. 12/2016, registered for offences punishable under Sections 341, 323, 498A, 354, 504, 506 and 379/34 of the Indian Penal Code.
Allegation against the petitioner is of cruelty and harassment to opposite party no. 2, who happens to be wife of the petitioner.
It has been submitted on behalf of the petitioner that he is still ready to keep the opposite party no. 2 with full honour and dignity but in spite of his best efforts, the dispute could not be settled between them. It has also been submitted
Patna High Court Cr.Misc. No.65405 of 2018(3) dt.06-11-2018 2/2 that petitioner himself surrendered on 12.09.2018 and since then he is in judicial custody.

Having heard both sides, considering the facts and circumstances of the case, nature of allegation and also that petitioner has no criminal antecedent and has remained in custody for about ten months, as such, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Banka, in connection with Banka (Mahila) P.S. Case No. 12/2016, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
