The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 324/325/326/307/341/504 of the Indian Penal Code and Section 27 of the Arms Act.
Diary in this case was called for earlier, which has, since been received.
Learned counsel for the petitioner submits that, though it is alleged that the petitioner had fired the shot which hit in the palm of the informant which is not on the vital part. The injury report from the private hospital is also not clear and distinct. After hearing learned counsel for the petitioner and on perusal of the case diary, it appears that though there is allegation against the
Patna High Court Cr.Misc. No.27810 of 2016 (3) dt.01-09-2016 P2/2 petitioner yet there was no repetition of fire arm injury so as to attract the provisions of Section 307 of the Indian Penal Code. In view of the aforementioned facts and circumstances and that the petitioner is not having any criminal antecedent, let the petitioner, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) wsith two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Begusarai Town P.S. Case No. 73/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Anjana Mishra, J) Saif/- U T
