The petitioner seeks bail in Bihiya P.S. Case No.256 of 2014 instituted for the offences under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act. It appears that accused persons have assaulted the victim. As per the Fardbeyan the present petitioner has taken a lead and fired from his licencee gun which hit the victim on the back side of the head. There is direct allegation against the petitioner.

Looking to the nature of allegation, this Court is not inclined to enlarge the petitioner on bail. Accordingly the prayer for bail is rejected. However, the trial court is directed to expedite the trial.
