JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 04-11-2015 Heard learned counsel for the petitioners and the learned Additional Public Prosecutor appearing on behalf of the State. These applications for grant of regular bail arise out of Tikari P.s. Case No. 319 of 2015, disclosing offences under Sections 419,420,386/34 of the Indian Penal Code.
Learned counsel for the petitioner, referring to the First Information Report, submits that the main allegation is against Satyendra Yadav who is said to have induced the son of the informant to pay him some money in order to ensure employment in a Bank. It is also alleged that informant was put under threat on a false pretext that certain Bank loan was due against him, though there was no such loan pending, and he was thus made to deliver money to in the name of getting the loan satisfied. Learned counsel for the petitioner submits that so far as he is concerned, there is no specific allegation against him and he has been implicated only on the basis of confessional statement of the said accused Satyendra Yadav, made before the police in course of investigation. The petitioner has no criminal antecedent, as stated in paragraph 3 of this application.
So far as petitioners of Cr. Misc. No. 48008 of 2015 are concerned, it has been contended that they were not named in the First Information Report. As regards petitioner no.2, of the said case there is absolutely no material, according to learned counsel. So far as petitioner no.1 is concerned, it is contended that his name has surfaced on the basis of confessional statement of the co-accused Satendra Yadav.
In view of the submissions as above, these applications
are allowed. Let the petitioners above named be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in Tikari P.S. Case No. 319 of 2015.
This is subject to the condition that the petitioners present themselves before the police/Court, as the case may be, and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
