The petitioner seeks bail in a case registered for offences punishable under Sections 399 and 402 of the Indian Penal Code and Section 25(1-b)A and 26 of the Arms Act.
As per the allegation, the petitioner along with four other persons were apprehend from the spot where they had assembled for the purpose of committing crime.
Learned counsel for the petitioner submits that there has been recovery of fire arms from other person but not from the possession of the petitioner and on the basis of confession of
Patna High Court Cr.Misc. No.42053 of 2014 (4) dt.21-01-2015 2/2 another co-accused Bipul Kumar Rai, it has been recorded that at the behest of the petitioner and one Ramanand Ram the person apprehended on the spot and were planning to kill the Mukhia. There is no material in the case diary to show the complicity of the petitioner.
Having regards to the facts and circumstances of the case, the petitioner, namely, Pappu Kumar Bharati is directed to be released on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Kaimur at Bhabua in Bhabua P.S. Case No. 395/2014.
