====================================================== CORAM: HONOURABLE JUSTICE SMT. ANJANA MISHRA ORAL ORDER 16-11-2019 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is apprehending his arrest in connection with Darihat P.S. Case No. 72 of 2012 for the offence registered under Sections 147, 148, 149, 152, 153, 353, 323, 431, 427 of the Indian Penal Code.

Learned counsel for the petitioner submits that the entire allegation against the petitioner is false and frivolous and he was not having any knowledge about the institution of such cases against him. He further submits that the petitioner shall appear as and when required in the proceedings and trial. It is further submitted that the allegations are in the nature of accusations and having made only particular allegation under

Patna High Court CR. MISC. No.55222 of 2019(3) dt.16-11-2019 2/2 Section 353.

Considering the aforementioned facts and circumstances and that the petitioner has clean antecedent, let the petitioner, above named, in the event of his arrest or surrender before the court below within four weeks, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount to the satisfaction of learned Judicial Magistrate Ist Class, Dehri-on-Sone, Rohtas, in connection with Darihat P.S. Case No. 72 of 2012, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
