The petitioner seeks bail in anticipation of his arrest in connection with Baikunthpur P. S. Case No. 211 of 2018 dated 14.08.2018 instituted for the offences under Sections 341, 323, 308, 504, 385 and 34 of the Indian Penal Code.

The petitioner and three others are said to have assaulted the informant by means of hard and blunt substance. The petitioner is specifically alleged to have assaulted the informant by an iron rod causing injuries on his chest.

Mr. Mukesh Kumar Singh, learned counsel for the petitioner submits that there is no injury report on record, which fact has been noted by the court below in the order

The petitioner has clean antecedents wheres the informant is a criminal minded person. His father has also filed a petition before the local police intimating that he ought to be put under check.

Considering the aforesaid facts as also taking into account the fact that the petitioner has clean antecedents, the petitioner, above-named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt / production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sri N. K. Pandey, Judicial Magistrate, 1st Clas, Gopalganj in connection with Baikunthpur P. S. Case No. 211 of 2018, subject to the conditions as laid down under Section 438 (2) Cr.P.C.
