In this case, the petitioner is seeking bail in connection with Barbigha P.S. Case No. 271 of 2015 registered for offences under sections 341, 323, 354-A, 504, 506, 379/34 of the Indian Penal Code and Section 3(i)(x) of the SC/ST Act. Allegation has been made against the petitioner, the informant has purchased a Saree and when it was found to be crack, she wanted to return the same whereupon altercation took place and the accused person abused her by caste name and also misbehaved with her.
The counsel for the petitioner submits that the Saree was purchased before a week and when she wanted to return the
Patna High Court Cr.Misc. No.47959 of 2015 (2) dt.02-11-2015 2/2 crack Saree then incident took place. Allegation has been made, exaggerated only when the Saree was not accepted, present case has been lodged.
The counsel for the petitioner submits that the petitioner is in custody since 11th August 2015. Looking to the facts and circumstances of the case, let the petitioner, above named, be released on bail on or after 10th December 2015 on his furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sheikhpura in connection with Barbigha P.S.
