JUSTICE MOHIT KUMAR SHAH ORAL ORDER 09-11-2017 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Sour Bazar P.S. Case No. 167 of 2017 registered for the offences under Sections 366(a) and 34 of the Indian Penal Code. The allegation is against one Kundan Kumar of kidnapping the victim girl. However, the victim girl, who is a major, has stated in her statement made under section 164 Cr.P.C. that she was having a love affair with the said Kundan Kumar and she has solemnized marriage with him and the said Kundan Kumar has not forcefully taken her away. The petitioner herein who is the brother of the said Kundan Kumar and father of the said Kundan Kumar, namely, Jay Prakash Yadav has also been roped

The learned counsel for the petitioner submits that the statement recorded under Section 164 Cr.P.C. would make it apparent that the petitioner has got no role to play and the father of the petitioner namely Jay Prakash Yadav has also been granted bail.

Having regard to the facts and circumstances of the case, petitioner Chandan Kumar is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Saharsa in connection with Sour Bazar P.S. Case No. 167 of 2017.
