Petitioner seeks bail in a case registered for the offences punishable under Sections 25(1-b)A/26/27 of the Arms Act.

The First Information Report was lodged on recovery of a dead body from the road side and from the place of recovery, firearm and cartridges were seized. The impugned order reveals that only material against the petitioner is confessional statement of co-accused before the Police and criminal antecedent of the petitioner.

Since there is no legal evidence against the petitioner for refusal of prayer for bail, let the petitioner, above

No.54157 of 2019(2) dt.02-09-2019 2/2 named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Balrampur Police Station Case No.34 of 2019, subject to condition that both the bailors shall be resident of the territorial jurisdiction of the learned court below and the petitioner shall fully co-operate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
