NATH ORAL ORDER 20-07-2016 Heard the learned counsel for the petitioner as well as learned additional public prosecutor. The petitioner is an accused in Agiaon (G) P.S.Case No. 62/2014 under Sections 420,406,302,201/34 of the Indian Penal Code.

Earlier the prayer for bail of the petitioner was refused by this Court by order dated 04.03.2015 in Cr.Misc.No. 2152/2015.

After considering the submissions and the statements on behalf of the petitioner as well as the learned additional public prosecutor, it is manifest that the petitioner is languishing in jail since 27.08.2014 and from the report submitted by the learned court below it does not appear that the trial would be concluded in

Patna High Court Cr.Misc. No.51167 of 2015 (5) dt.20-07-2016 near future. It also does not appear that any direct material has come during investigation showing involvement of the petitioner in the alleged crime.

In view of the facts and circumstances of the case and after considering the submissions, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of Leaned A.D.J. 6th Ara in S.Tr. No.178/ 2015 in connection with Agiaon (G) P.S.Case No. 62/2014 subject to the following conditions:

(a) The petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court;

(b) The petitioner shall be well represented on each date in the court below and his failure to do so on two sequential dates shall entail cancellation of his bail bonds;

(c) The petitioner shall abide by the above conditions scrupulously and in case of violation of any of the conditions, the prosecution would be at liberty to move the Court for cancellation of bail. (V. Nath, J) Nitesh/- U T
