JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 27-10-2015 Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the State.

This application for grant of regular bail arises out of Kishanpur P.S. Case No. 76 of 2015, disclosing offences under Sections 313, 376, 393, 341, 323 and 504/34 of the Indian Penal Code.

Learned counsel for the petitioner has submitted that it would be evident from the First Information Report that physical relationship, if any, between the petitioner and the informant was out of mutual consent. She further submits that the Doctor has found the age of the victim girl to be between 18 to 19 years. In view of the submission as above, this application is allowed.

Patna High Court Cr.Misc. No.47400 of 2015 (2) dt.27-10-2015 2/2 Let the petitioner, above-named be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul in connection with Kishanpur P.S. Case No. 76 of 2015.

This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
