JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 03-11-2015 This is an application for grant of regular bail in favour of the petitioner who is an accused in connection with Barachatti PS Case No. 116 of 2014 registered for the alleged offences punishable under Sections 302, 201 and 34 of the Indian Penal Code.

The petitioner is in custody since 28.7.2015. He does not have any criminal antecedent. Learned counsel for the petitioner submits that over and above the suspicion raised by the informant in her statement, there is no specific allegation against him. He further contends that co-accused Rajesh Manjhi, against whom there is some allegation, has been granted regular bail by this Court vide order dated 4.3.2015 passed in Cr. Misc. No. 45308 of 2014.

In view of the submission as above, this application

Patna High Court Cr.Misc. No.47398 of 2015 (2) dt.03-11-2015 2/2 is allowed.

Let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri N P Singh, Judicial Magistrate 1st Class, Sherghatti, Gaya in Barachatti PS Case No. 116 of 2014.

This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
