2. The petitioner seeks bail in a case registered for offence under Sections 126(2), 115(2), 117(2), 109, 74, 3(5) of the B.N.S., 2023 and Section 27 of the Arms Act.
3. Learned counsel for the petitioner submits that altogether 33 persons have been made accused in the present case due to long standing land dispute between the parties. Allegation is general and omnibus. He further submits that present case is counter blast of Maigra P.S. Case No. 72 of 2024 (Annexure P/2), instituted against the informant and other from the petitioner's side, which is earlier in point of time. Some of the similarly situated co-accused have already been granted anticipatory bail by a coordinate Bench of this Court, vide order
Patna High Court CR. MISC. No.55472 of 2025(3) dt.26-09-2025 2/2 dated 30.07.2025 passed in Cr.Misc. No. 46435 of 2025. Petitioner is in custody since 11.05.2025, having clean antecedent. Chargesheet has been submitted.
4. Learned A.P.P. for the State vehemently opposed the bail petition.
5. Considering the period of custody, clean antecedent and the fact that some of the accused have already been granted anticipatory bail, the prayer for bail of petitioner is allowed.
6. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Sherghati, District - Gaya in connection with Maigra P.S. Case No. 73 of 2024.
