ANJANA MISHRA ORAL ORDER 18-12-2017 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State as also the learned counsel for the informant.
The petitioner is in custody since 19.09.2017 in connection with Lauriya P.S. Case No.172 of 2017 registered for the offence under Sections 147, 148, 149, 341, 323, 307, 302 and 506 of the Indian Penal Code.
Learned counsel for the petitioner submits that the main allegation is against one Shambhu Yadav, who is alleged to have attacked the deceased Jhulan Yadav. The allegation against this petitioner along with other co-accused persons is that they had also attacked and assaulted by means
Patna High Court Cr.Misc. No.59071 of 2017 (2) dt.18-12-2017 2/2 of Lathi and bamboo. One co-accused Suman Yadav is said to have attacked one Nibha Kumari by means of iron rod. Learned counsel for the petitioner submits that said Suman Yadav has since been extended the privilege of regular bail in Cr.Misc. No.54119 of 2017, vide order dated 13.12.2017. Furthermore, it is submitted that the post-mortem of the deceased indicates only one injury on the head. Considering the aforementioned facts and circumstances and that the petitioner is also not having any criminal antecedent, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-1st, Bettiah, District-West Champaran, in connection with Lauriya P.S.
