The petitioner seeks regular bail in connection with Sono P.S. Case No. 97 of 2019, registered for the offence punishable under Sections 399, 402, 34 of the Indian Penal Code and Section 25(1-B)a, 26 and 35 of the Arms Act. The allegation is regarding the police having apprehended the petitioner when the police party was on patrolling duty and had received secret information about the accused persons planning to commit some crime. Upon search being made, one country made pistol, one live cartridge and two Samsung mobile phones etc. were recovered from the possession of the petitioner apart from a Hero-Honda (Splendor) which was lying nearby, papers / documents whereof could not be produced by

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and admittedly, even as per the F.I.R., the motorcycle was lying at the place and the petitioner has got nothing to do with the alleged crime. The petitioner is stated to be having a clean antecedent and he is languishing in custody since 31.3.2019. Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.
Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM 1st, Jamui in connection with Sono P.S. Case No. 97 of 2019.
